If the police asks someone to do something and he refuses to cooperate, then I would be pretty damn suspicious of the guy as well.
I was watching a news report on this a couple weeks ago and they say the told the guy to stop several times. I don't know that they really needed to fill the guy full of lead, but I could only imagine whats going through the cops mind at a time like that.
