Legal advice needed...
 
I got in some trouble and need some advice. If you know or know anyone who knows legal stuff please help out.

I was picked on the 14th of Dec for DUI and Possession with intent to sell. I spent 2-1/2 days in LA County Jail, to be released on the morning of the 17th. I was never charged for anything or saw a judge. It was explained to me by other inmates that they had 72 hours to charge or release me. I was also told that once released that they couldn't press charges since I already served time.

Skip to today, in the mail I recieved a letter from the Cali Highway Patrol. It states that I'm due in court on the 23rd of March for the charges that I was originally taken in for.


The confusion comes with what I was told in jail. I ran this by several friends who have served time and they pretty much confirmed what I was told. Obviously none of us are lawyers so we really don't know.

Would anyone like to share some insight if they could. I don't want to spend 2k on a lawyer just to have them get me off cause I already served.

my advice would be.. don't drink and drive and don't do drugs but that doesn't help you out now

but on a side note, you dont have to have anything illegal to get intent to sell. i was once held on "intent to sell" what did i have? i had 5 freaking darvacets from when my mom was dying of cancer. they were 5 years old and found in my glove box med box.....hmmmmmmmm now was i really trying to sell or were they being asses? so good luck and get that lawyer asap! and next time dont be a freaking idiot!

Just because you werent actually told you were being charged didnt mean your paper work wasnt being done.....The court date wouldnt be any time soon after the arrest ( 1 week or 2) I takes along time for the paper work and everything to get to you...but yes definetly talk to a lawyer.......good luck and be ready to shell out some :dollar: :dollar: :dollar:

last time I checked they had to explain to you what laws you had broken, how you broke those laws and had you sign a piece of paper saying they did that.. that's what happened when I got pulled over and I'd think it'd be the samething with this :confused:

^those are for traffic violations only. the intent to sell doesnt need a siggy. my dads a cop.

as for can they charge you, im not to sure. but i can find out.

Good luck hun... no lawyer took my case for my accident.. so.. im stuck with $45Grand in med bills...

Get a lawyer, get a lawyer, GET A FUCKING LAWYER. No matter how safe you think you are, there's always a bunch of bullshit people tell about the law. For some reason people still think that if you ask someone if they're a cop, they have to answer honestly. Dumbasses. The charge/release law does apply to some states, but for some reason I doubt Cali is one of them. They seem so gung-ho to get rid of any kind of crime that they'd do away with shit like that. If you got popped on the DUI, I at least hope you didn't take a breathalizer or take the field sobriety test (if you were actually drunk). That'll give you a lot of wiggle room on a DUI charge. As for the possession charge...you're pretty much screwed if they decide to go on with the charges and they can prove you had an illegal substance.
