My accident was fraud!
 
I spent about 1 hour on the phone with the insurance company. When I rear ended the guy, it was just him. He had no passengers. NOW, he is claiming that there was a passenger in his car the time of the accident and that they are BOTH injured (even though the guy said he was just fine). I reported that it was just him in the car and so did my friend (who was in the car with me the time of the accident). The lady I was talking to was VERY nice and was telling me all about fraud and how the MO of my accident is a VERY popular fraud scam. She will be forwarding it to the fraud dept. and they will be following up on this. I still get an at-fault letter in the mail, but she told me that if the investigation goes through (which it will) and they find that he is filing a fraud case. I will be cleared of everything, I wont be at fault, and he goes to jail. She said most likely this will happen because he showed all signs of a red flag fraud reporter. Also, when I called the police (when I found out he had no insurance) and I told him that they were on the way. He was eager to leave, which he ended up doing after about 15 min of waiting. Very suspicious!

I told him that the 911 operator told me to tell him NOT to leave and that if he left they would contact him because I had his information. I think the fact that I said I had his info made him stay (for the short period that he did end up staying), but he ended up leaving. The officer went around a few blocks looking for him but never found him...

Yeah you did. But isn't it HIS fault anyways for not staying at the scene of an accident. I believe it is a law that you have to stay at one (even if you are not involved) Plus HOW could he have proof of that when he never even stayed at the accident (what would be his argument for not staying?!?)

I think you have a simple case! :yes:

Don't worry about it.. fraud or not it will not be your fault. If they say so, then get a lawyer and sue. I used to live in cali, and no insurance = no drive. If he doesn't have insurance it is his fault regardless. Why? Because without insurance she shouldn't even be on the road. The fact this moron is trying to get money out of you if dumb of him. I would sue his ass. Open/Closed case.. I would seriously press this and get this ass thrown in jail/sued.
