well guys i get to go to court. not becuase i have jury duty. but because a couple weeks back a 17 yr old teen tried stealing a bottle of vodka from my work. i chased him out the store and off store property and caught him. tackled him and put a nice move on him after hitting him to get him to stay down. while 2 other of my employees were right behind me. catching up to us. my boss who was there used his cell to called the cops. the cops took a report and everything. well sense i tackeled him off store property i guess i committeed assualt. so now im being accused of assualt and battery. mean while the 17 yr old kid is off on probabtion and perfectly fine. no scares or bruses. not even a scratch. WTF!?!?! how did i assualt him if he isnt hurt?

but this will all be decided this friday.

dress nice, agree with the judge, explain your story, make sure you explain why you needed to hold him down wether he was trying to run or whatever. best of luck to ya

yea i know. its still crap to me. he fought with me and everything. hell he hit me with a bow before i got my fore arm across his face. ARGH.

Like previously stated, the court system gives more power to the criminal then the defendant, which in some cases is somewhat bullshit.

well im in a waste deep in shit now. the marines want a the police report. after all if convicted of any crime you are dishonoralbly discharged.

All you have to prove is that he put up a fight. He's probably got a decent defense attorney that is argueing you "assaulted" him because you subdued him. I think any compitent judge will see that you were merely protecting your comapny's interests. I've seen similar complaints against coworkers who chased shoplifters out of the store and took them out...they were all dismissed since the actions were undertaken during the commission of a crime. If he hadn't stolen he wouldn't have had to be detained. And ehat about this kid? His credibility has to be shit since at the time of your report he was a minor in possession. I don't think you'll have any trouble beating this one.

Even if you do lose this case, which you won't, the military shouldn't have to discharge you dishonorably...and if you did get discharged, which you won't, you should get general since you were doing your job.
You can't file assault on him???

^^ This is true...I've got a friend who used to do some sort of combat stuff (don't ask me what...I don't have a clue). He got busted with coke and now he's a chairborne ranger.

I think it depends because I have a friend who got dishonorably discharged for possesion of coke...he was in the Navy...he can't get any good job for the rest of his life...

well the case was dismissed. so im off scotch free. the judge actually thought it was funnt he was trying to sue me. lol.

A lot of companies have policies against chasing down thieves because of the very thing that happened to you. If they aren't out the door they aren't shoplifting and if they're off your property they can sue you for assault. It's piss poor...but that's the way the law works.

Yeah. I have a friend who works at Home Depot and they aren't allowed to touch anybody they think is stealing. They have to contact a security person, and even then, those people can't touch people outside AFAIK. Crazy world.

thanks guys. i think that is shit. we give to many rights for the wrong things. society blows. i remember watching out school films and people didnt need reasons, propable cuase or anything to stop someone if they are suspiecious.

crimminals have no rights. i remember reading that out of my history book. now i read Crimminals have equal rights as the innocent. when times change it seems like everything changed.

Don't believe everything you read on mass-messaged emails. If they were true, I would be making tons of money and be rich just by clicking "reply to all" since apparently Bill Gates would pay me ~200usd for each email sent to other people, and then it would be like a pymarid where I would get less and less for each person and circulated to afterwards. Hrmm...maybe I should try it out. I mean bill gates'll waste money to track my emails and then pay me since he just likes me so much for stealing software eh :rolleyes:
