LOS ANGELES (Reuters) - A 26-year-old Los Angeles man who prosecutors say shot at two thieves stealing his car, killing one of them, was charged on Wednesday with murder.



Yoon Ho Song could face 50 years to life in prison if he is convicted of the first degree murder of Mario Sandoval Martinez and a special allegation of using a handgun, a spokeswoman for the Los Angeles County District Attorney's Office said.


Prosecutors say Song came out of his house to find two car thieves pushing his customized Honda out of his driveway in the predawn hours on Monday and opened fire, hitting Martinez, 25, in the back. The second suspect got away.


"The fact that your car is being stolen isn't a legal justification for killing somebody," Deputy District Attorney Frank Somes said. "Generally, you're not allowed to kill people unless they are committing a violent felony or you are acting in self defense."


Somes said police initially focused on Song as a crime victim but "essentially began questioning whether he was the victim or a suspect when they learned the person stealing the car had been shot in the back."


An attorney for Song, who was expected to make his first court appearance in the case as early as Wednesday, could not be reached for comment

I say that you get what's coming to you. If you go and steal someone's pride and joy...please...be prepared to get shot at or beat up. I don't think they shouldhave charged that dude with murder...of course he should probably do some time but not 50 years...his car almost got stolen...he was just protecting his possesions...

I agree; I mean put it this way: If the guy wasn't commiting a crime in the first place, he wouldn't have a bullet in his back...

Although death is a TAD too far, but still, 50 years is crazy talk.

Well with all the recent reported cars being stolen such as hondas and acuras id probs go do the same thing. Cause it seems theres goin to be no end to this bullshit and the cops cant do a damn thing but go about 2 days later and find the car and there is nothin left but the shell.

Well...the guy's adrenaline probably hit the roof and didn't know how to react...I would probably try to shoot him in the leg or something...somewhere where he won't die if I hit him...I just think things happened so fast for him that he just lost it...maybe??

yeah, thats kinda what i was thinking, this might not have been as much self defence as we're giving the guy credit for.

our laws give criminals more rights than victims. And the great thing is we don't care. Nobody has questioned this problem.

I say he did the right thing. In the eyes of the law however, he did the wrong thing. He should've called the fantastic and ultra responsive police department, they'd arrest the theives, and they'd be out in a year to steal his car again...or f**k with him for the rest of his life.

I say he should've killed them both, and buried the bodies.

I'm with Blind...shoot 'em in the back, face, wherever you can get a shot off. People like that don't deserve to walk around with the rest of us and even if they were to catch them you get what....maybe 5 years for grand theft auto? They'll just be right out there a week after getting released doing it again. I mean...I know how to hotwire a car with little or no damage to the interior, but do I go around doing it? No...because I think about how I'd feel if someone did it to my car (you can have the truck...just don't touch the Mustang). It's sad that the law doesn't give you measures to protect your own property. Forget killing them...what if he'd beaten them? He'd have gotten charged with assault and probably gone to jail longer than the dipshits trying to steal his stuff. This I know firsthand. About 4 years ago I came out of work to find some guy fiddling with the door handle and lock on my car. I walked up to him and said "can I help you?". Right then he turned around to swing at me (must've been drunk cuz I was still a good 4 or 5 feet away) and now I'm thinking about the truckin buddy in my right hand and how I've got cause for self defense. So right after he swung he got cracked upside the head with a big metal retractable baton and kicked a few times in the head/face after he hit the ground. I got detained overnight (though not arrested...just cuffed) on suspicion of aggrevated assault and released in the morning on the grounds of self defense. I just regret having any self control to stop kicking him. But I'll gladly trade one night of question for him going to the hospital with a concusion, broken nose, and 3 teeth missing and THEN going to jail.

what the guy should've done was when he realized he was dead, go and drag the body inside his house and say he found him in his house then shot him

I would say if u catch anyone stealing ur ride or fucking around with it beat them or shoot them but don't kill them. I know if i were to lay hands on who ever stole my car back in july i would prolly do the same thing as he guy did.

I'm about 6'4" 215lbs or so. Not huge and by no means am I usually violent. It's just that these people have absolutely no idea how much people put into their cars...the effort, the time, the money. The main problem with self defense laws is that they're so subjective. A guy breaking into my car or my home to me poses a potential for bodily harm. Probably 8 out of 10 times these people are in some way armed. So by the time you're sure you're in some kind of bodily danger...say you've got a gun in your face...it's probably too late to defend yourself. So I say take a preemptive strike and do whatever you gotta do then deal with the consequences later.

I dont see what the problems are. They bastards where stealing. They used to cut hands off for that. And the only reason he shot him in the back isnt because of cowardice but the fact the ass hole thieve was PUSHING his car on down the road. Gt what he deserved.

Don't shoot him in the leg. Then you'll be charged with attempted murder and he'll sue you for emotional and physical distress. If you're going to shoot someone, shoot to kill. But don't shoot unless you've got a good case.

Run them down and go for a good smackdown instead.

Actually to be charged with attempted murder you have to shoot above the waist (in most states). Shooting someone in the leg is generally assault with a deadly weapon unless they can show your original intent was to kill them and you screwed up. I say go for the spine. That way they'll still be alive and miserable. I'd love to see some guy in a wheelchair try and jack my car.

Alright...I've got an altogether new idea. Instead of shooting them I'd take one of them down and torture him. I'm not talking that sissy battery cables to the nuts torture...I've got a better one in mind. Tink of mafia-style knee-capping. You know...putting a guy's legs up on a chair and shooting him in the kneecaps. I'll do you one better. Prop his legs on a chair and take a power drill to his kneecaps...or maybe a Dremel tool...that'd probably take longer and leave him in more pain. Then stuff his body into a duffel bag and throw it out the window of your car as you speed past a hospital. Worst you could get would be assault with a deadly weapon. If it's a first offense you don't get much...that's if they catch you.
