ok here i go... any advice would be appreciated

i recently purchased a technics sl1200 turntable off of ebay. paid 325 plus 30 dollars to ship it through paypal. seller ships and ups loses package. seller tells me that ups will only pay 100 dollars and the cost of shipping back (total fo 115) and seller only is giving me the 115 back.

question: isnt it the sellers fault that he did not insure the package to the amount i paid? so shouldnt the seller refund the full amount?

also if seller wont refund the full amount is their anyway to get a refund through ebay or paypal?

you shouldnt have to pay for it if you haven't gotten it. He could be pulling a fast one on you. If he declared the package to be worth 325$ then UPS should refund him for the full amount plus the cost of shipping.

Maybe you can get incontact with paypal, UPS and ebay and figure out whats really going on here, this smells like troube to me

Did you pay for insurance? Does he have proof that UPS lost it?

UPS default insured value is $100 unless you pay for more. If UPS genuinely lost it, you're screwed most likely.

yes ups did lose the package. i recieved the tracking number the same day he shipped it. and i checked it like a week later and it said it had arrived in richmond (1 hour and 30 min away) 5 days before and had not left. so i had the seller put a tracer on it and 8 buisness days later ups declared it lost

hmm default UPS insurance is 250USD for us at work, and we dont pay more for it, maybe thats because we're a business or maybe because were in canada.

For starters i would be getting on the phone with the seller and be telling him you need the difference between 100 and what you paid. Its not right for this type of thing to happen. Yes he will be out the goods, but legally I think you could take him to court over this. My thinking is that you've paid for something that was never delievered... not being the legal expert around here you might hit up girlracer aka quin for details, she does legal work for a living and would probably be better off to answering your questions then us shmucks.

Btw details like what state he was shipping out of might help you if you do end up going legal.

did you pay the guy for insurance costs when u sent the money to him?...if not then the guy isnt at fault for UPS losing the package b/c he didnt have to put insurance on it because you didnt pay for the insurance...

well i gave him 30 dollars for shipping and he only paid 15 for shipping. he never offered insurance and i didnt know about the ups policiy of only refunding 100 dollars if not insured.. never shipped anything through ups

well i looked online and paypal and ebay both have protection policies and paypal has a service that they will try to contact the seller to get the money back and if that doesnt work they cut off access to their payapl account but neither method paybal or ebay gaurantees your money back..

also i paid for this via paypal, which i had approx 200 dollars in it. paying for this throught paypal deducted that amount plus 155 from my visa check card from bank of america. im guessing i could just take the 115 from him and file a dispute with my bank and get the 155 back for a total of 270 and just take a loss of 85 bucks if nothhing else works.
